NY-0752-02-0116-I-1 (MSPB, Fudin prevailed in court. 5/14/2002) ...In this document, the ALJ ruled in Dr. Fudin`s favor and ordered him returned to his job at the Stratton VA. Interestingly, the court transcripts reflect that the ALJ REFUSED to hear any testimony pertaining to reprisal for whistleblowing. In the final decision, she states that Dr. Fudin failed to prove reprisal. That in and of itself is a lack of statutory requirements.
